(A) This Privacy Policy forms a part of the terms and conditions (the Terms and Conditions) governing your use of the Website and the Services provided by Ashley & Martin (Singapore) Pte. Ltd. (hereinafter, collectively, referred to as “Ashley & Martin”, “we”, “our” or “us”) and its related corporations and should be read in conjunction with such Terms and Conditions. Defined expressions in the Terms and Conditions shall have the same meanings when used in this Privacy Policy unless the context otherwise requires or unless otherwise defined in this Privacy Policy.

(B) Our rights under this Privacy Policy shall be without prejudice to other rights of collection, use or disclosure available pursuant to any terms and conditions or under the law and nothing herein is to be construed as limiting any of these other rights.

When you answer any question on the Website, proceed to pay for the Services or provide any other information to us in the use of the Services, we collect data which enables you to be identified or identifiable, including but not limited to:

When you provide us with Personal Data in the use of the Services, whether to complete the online questionnaire on the Website, verify your Card, attend to video and/or voice call(s) with our Healthcare Providers, arrange for a delivery or otherwise perform a transaction on the Website, you are deemed to consent to our collecting of such Personal Data and using it for that specific reason. If your Personal Data is required for a secondary reason, like marketing, we will either seek your express confirmation or provide you with an opportunity to decline.

2.3 When you provide us with any Personal Data:

(a) you represent and warrant that (i) you are the owner of such Personal Data provided that that you have been notified of the Purposes (as defined in paragraph 3.1 below) for which such Personal Data will be collected, processed, used or disclosed and (ii) you consent to our collection, processing, use and disclosure of your Personal Data in connection with the Purposes;

(b) you shall notify us immediately if you wish to withdraw your consent under paragraph (a) above, and acknowledge that such withdrawal of consent may affect the Services which we are able to provide to you; and

(o) to assist us in conducting or co-operating in investigations or proceedings relating to fraud or other illegal activity where we believe it is reasonable and appropriate to do so;

(p) to comply with or as required by any applicable law, governmental or regulatory requirements of any jurisdiction applicable to us or our Healthcare Providers, including meeting the requirements to make disclosure under the requirements of any law binding on us or our Healthcare Providers, and/or for the purposes of any guidelines issued by regulatory or other authorities (whether of Singapore or other countries) (such as but not limited to the Singapore Medical Council Ethical Code and Ethical Guidelines), with which we or our Healthcare Providers are expected to comply;

(q) to comply with applicable legal obligations or requests from government authorities, when we believe an applicable law or government directive requires it or generally doing so would be in the interests of national security or to protect our rights, property, safety or security or otherwise that of the visitors to the Website or other third parties; and

(r) other purposes reasonably related to the aforesaid.

3.2 We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.
